‘NO WIN NO FEE’

The advent of No Win No Fee Agreements, has made litigation far more accessible to litigants. Where once commercial litigation was reserved to large companies, it is now possible for smaller companies to bring claims with a relatively small exposure as to costs.

If the claim has sufficient merit and the Defendant appears of sufficient means to meet any award made against it, we may be prepared to act on your behalf under a No Win No Fee Agreement. This would mean that we would only charge you should your claim be successful and we are unable to recover our costs from the other party.

By obtaining Legal Expense Insurance, you would also be protected from an adverse costs award should your claim fail. Give the costs of litigation, this is a considerable additional benefit. Legal Expense Insurance premiums are high, but we at Eastleys have access to Insurance policies the premiums for which are repaid under the terms of a loan agreement. This loan would only be repayable if the claim is successful, when the premium should be recoverable from the other party. As a consequence, it is perfectly possible for a party to bring a large commercial claim, professional negligence claim or inheritance act claim under a No Win No Fee Agreement.

Public Funding
More people than ever are now eligible for Public Funding (previously known as Legal Aid). If your gross household income (including that of any partner) is below £27,500 and you have savings of less than £3,000 you may be entitled to Public Funding in order to pursue or defend your claim.
