Children disputes
Mr C was separated from his former partner Miss T with whom he had a 5 year old daughter. He saw the daughter quite often but the relationship with Miss T was always difficult and there was very little communication between them. Out of the blue he received a letter from Miss T informing him that she would be leaving the country with the child in a few days time and there was nothing he could do to stop her.

We advised Mr C to issue an urgent application for a prohibited steps order to prevent the child from being moved at least temporarily while investigations could be made as to the suitability or otherwise of the move. We made an application to the court on the same day and a court hearing took place a few days later.

The Judge, having heard the evidence, decided that the child could accompany Miss T to her new home in the Channel Islands but also made an order for defined contact so that Mr C could continue to see his daughter regularly and knew where she was living and where she would be going to school. The Judge ordered that the matter be brought back before the court in a few months time to review the situation.

Mr C was satisfied that proper arrangements had been made for him to carry on seeing his daughter and have a real involvement in her upbringing. Return to Case studies.
