FINANCIAL PROVISION FOR CHILDREN INFORMATION SHEET
A parent with care of a child can apply to the Child Support Agency for maintenance/child support.

A parent can also apply for a lump sum payment (Lump Sum Order) or for the transfer of property (Property Adjustment Order). An application can be made in either the Family Proceedings Court (Magistrates) or the County Court. In the Family Proceedings Court the maximum lump sum payable is ,1,000. If a lump sum in excess of this sum is sought an application must be made in the County Court.

When considering making an Order, the Court takes into account the following matters:-

i) The income or earning capacity, property and other financial resources which each party has or is likely to have in the foreseeable future;

ii) The financial needs, obligations and responsibilities which each parent has or is likely to have in the foreseeable future;

iii) The financial needs of the child;

iv) The income earning capacity, if any, property and other financial resources of the child;

v) Any physical or mental disability of the child;

vi) The manner in which the child was being or is expected to be educated or trained.

The costs arising out of the birth of a child can also be claimed.
